Grantee Information
Important Definitions
As used in this Agreement, the following terms shall have the meanings set forth below:
Client
Resident low-income or very-low-income family with at least one child under the age of eighteen years old living in a single family home or apartment unit which (a) is located in Cook County, (b) was built before 1978, (c) contains a lead-based paint hazard and (d) which is selected by the Grantee for the receipt of Project Services. For purposes of this definition, “low-income” or “very low-income” shall refer to families with incomes at or below 80 percent of the area median income level.
Contractor The licensed lead abatement service provider with whom Grantee contracts to provide Project Services pursuant to this Agreement.
Delegate Agency A unit of local government or health department approved by the Illinois Department of Public Health to carry out the provisions of the Lead Poisoning Prevention Act, 410 ILCS 45/1 et seq.
Grantee The recipient of funding under this Agreement.
Lead Supervisor, Lead Worker and Lead Contractor Shall be defined as set forth in the Lead Poisoning Prevention Code, 77 Ill. Adm Code 845.10 and shall meet the requirements stated therein at 77 Ill. Adm Code, 845.27.
Notice to Authorizes the Grantee to permit work to begin on the Units which it has described in its Service List.
Occupant Relocation Costs The temporary relocation and moving costs or other expenses which result from a Client being relocated from his/her Unit while Services are provided to the Unit.
Program Director The director of the Cook County Department of Public Health Lead Poisoning Prevention Unit.
Project The activities of the Grantee which are conducted with Funds made available through this Agreement as set forth on Exhibit A.
Project Completion Date shall mean the October 31, 2003, or such date as has been approved in writing by the County for completion of all Project Services to be reimbursed, in whole or in part, with the Funds.
Project Services Lead–based paint hazard reduction services provided to Units utilizing Funds made available the Grantee under this Agreement and shall include services performed or contracted by Grantee.
Property A single family residential dwelling or a multi-unit rental residential dwelling which: (a) is located in Cook County, (b) was built before 1978, (c) contains a lead-based paint hazard, (d) contains unit(s) which is/are occupied by a low income or very low income family with at least one child under the age of eighteen years old and (e) which is selected by the Grantee for the receipt of Project Services. For purposes of this definition, “low-income” or “very low-income” shall refer to families with incomes at or below 80 percent of the area median income level.
Service List A complete list of Units with their Cook County Property Index Numbers which are ready to be scheduled for the provision of Project Services, a signed certification from the Delegate Agency that Work Orders for all Units included therein have been reviewed, and an indication of which Properties, have a mitigation notice, a mitigation order, or an abatement order as defined under the Act, are an immediate risk of lead exposure to children, and, if any, are within a flood hazard area, as designated by flood hazard area maps created by the Federal Emergency Management Agency.
Unit A single family home or apartment unit which: (a) is located in Cook County, (b) was built before 1978, (c) contains a lead-based paint hazard, and (d) contains unit(s) which is/are occupied by a low income or very low income family with at least one child under the age of eighteen years old. For purposes of this definition, “low-income” or “very low-income” shall refer to families with incomes at or below 80 percent of the area median income level.
Work Order A detailed lead mitigation or abatement plan submitted for approval where required by Delegate Agency and listing details of all the required worker and occupant safety measures, occupant relocation requirements and all lead mitigation/abatement procedures and materials to be used in a Unit.
